nderstanding the 25th Amendment and Its Potential Use Against Donald Trump

Posted on January 30, 2026

Amid ongoing discussions regarding Donald Trump’s unusual interest in acquiring Greenland, some members of the Democratic Party have suggested the potential use of the 25th Amendment to address this situation.

Since his return to the presidential office, Trump has repeatedly expressed a desire to take over Greenland, citing national security as the primary justification for such an action. This controversial stance has triggered a wave of disapproval from European nations.

In retaliation to the criticisms from Europe, Trump proposed tariffs on goods from eight European countries, starting with a ten-percent increase in February. It’s worth noting that these tariffs could escalate to 25 percent by June if the acquisition of Greenland doesn’t proceed as he envisages it. This move has raised concerns about the potential for escalating tensions on the global stage, prompting discussions around employing the 25th Amendment for his removal from office.

What Exactly is the 25th Amendment?

The 25th Amendment was developed by federal legislators after the traumatic assassination of President John F. Kennedy in 1963. Its main aim was to elucidate the process for presidential succession and to address any incapacities of a sitting president.

Particularly notable is Section 4 of the amendment, which provides a mechanism for the vice president to assume presidential responsibilities temporarily without an official removal of the sitting president. If opposition from the current president arises, Congress possesses the authority to enforce this transition via a two-thirds majority vote in both the Senate and the House.

To activate this provision, the vice president, currently JD Vance, in conjunction with the majority of the Cabinet’s 15 members, must collectively attest that the president is unable to discharge the duties of the office. Although not yet utilized to depose a president permanently, it has been applied in past instances to temporarily transfer powers to vice presidents.

Recent Advocacy for the Amendment’s Invocation

California’s Representative Maxine Waters, among others, has been vocal about the need for action to prevent further potential damage by Trump during his presidency. Highlighting concerns over his attempts to influence the Federal Reserve and control interest rates, Waters argued these actions jeopardize the country’s economic stability.

Her comments suggest an authoritarian streak in Trump’s behavior, which she believes could disrupt the broader economy, thus calling for the application of the 25th Amendment.

Similarly, Massachusetts Senator Ed Markey has publicly shared his concern, recently stating on X: “Invoke the 25th Amendment.” This came after revelations by the New York Times concerning Trump’s continued efforts to annex Greenland, following his unsuccessful bid for a Nobel Peace Prize.

Further intensifying the issue, Trump sent a letter to Norwegian Prime Minister Jonas Gahr Støre, which alarmed many by expressing no longer operating on a premise of “pure peace.” He hinted at punitive measures against Norway, an allied nation, after they chose not to grant him the Nobel Peace Prize.
